Terms & Conditions

Effective date: May 1, 2026. These Terms govern access to and use of the Ommify platform and website operated by Ommify Technologies Pvt. Ltd. By using Ommify, you agree to these Terms.

1. Definitions

“Ommify”, “we”, “us” means Ommify Technologies Pvt. Ltd. “Customer”, “you” means the entity or person using the Services. “Services” means Ommify software, APIs, dashboards, integrations, and related features.

2. Account & eligibility

  • 2.1 You must be able to form a legally binding contract and have authority to accept these Terms for your organization.
  • 2.2 You are responsible for safeguarding credentials and all activity under your account.
  • 2.3 You must provide accurate information and keep it updated.

3. Acceptable use

You must use Ommify in compliance with applicable laws and Meta/WhatsApp policies. You must not:

  • 3.1 Send spam, unsolicited messages, or messages without valid consent/opt-in.
  • 3.2 Use misleading, deceptive, or prohibited content (including scams, impersonation, or unlawful activities).
  • 3.3 Attempt to bypass platform controls, security, rate limits, or policy enforcement.
  • 3.4 Upload malware or exploit vulnerabilities.

We may suspend or terminate accounts that violate these rules or if required by Meta/WhatsApp to prevent misuse.

4. WhatsApp / Meta compliance

  • 4.1 Message delivery and account status depend on Meta/WhatsApp rules, phone number quality rating, and policy compliance.
  • 4.2 WhatsApp may limit or block messaging if it detects spam, high complaint rates, or policy violations.
  • 4.3 You are responsible for your templates, content, targeting, consent, and end-user communications.

5. Fees, billing, and taxes

  • 5.1 Subscription and usage fees (if any) are billed as per your plan and invoices.
  • 5.2 You authorize us and our payment partners to charge your payment method for applicable fees and taxes.
  • 5.3 Taxes (including GST) may apply as per law and will be shown on invoices where applicable.

6. Data, privacy, and cookies

Our Privacy Policy describes how we process personal data and use cookies. By using Ommify, you agree to such processing.

You represent that you have lawful basis and required consents to share end-user data with Ommify and to contact end users on WhatsApp.

7. Service changes & availability

We may change, suspend, or discontinue parts of the Services, including integrations, if required for security, compliance, or third-party changes. We aim for high availability but do not guarantee uninterrupted service.

8. Termination

  • 8.1 You may stop using the Services at any time.
  • 8.2 We may suspend or terminate access for breach, suspected fraud, abuse, or policy violations.
  • 8.3 Data deletion and retention are described in the Data Deletion Policy.

9. Limitation of liability

To the maximum extent permitted by law, Ommify is provided “as is”. We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill.
